1. About these Terms
These Terms & Conditions (“Terms”) govern your use of the FUTURES website and platform, including the creation and management of profiles and the use of features made available through the platform.

By using the FUTURES platform, you agree to these Terms.
If you do not agree with these Terms, please do not use the platform.
Our Privacy Policy explains how we process personal data, and our Cookie Policy explains how cookies and similar technologies are used on the website.
2. Who can create an account?
FUTURES accounts are intended for users aged 18 and over.
The platform includes different types of profiles and participants, including:
- FUTURES member organisations;
- cultural institutions;
- Learning Programme Alumni;
- Residency Programme Artists; and
- Artists nominated by FUTURES member institutions.
The availability of an account or a particular profile type may depend on the user's relationship with FUTURES and the relevant programme or activity.
FUTURES reserves the right to determine eligibility for specific profile types and programmes.
3. Accounts and profiles
Where the platform allows you to create an account, you are responsible for providing information that is accurate and keeping your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for activities carried out through your account. You should notify FUTURES if you believe that your account has been accessed or used without your authorisation.
FUTURES may contact you using the contact details associated with your account in relation to your profile, your participation in FUTURES activities, or the operation of the platform.
4. Your profile and information
Users who have access to profile functionality can create, edit and update information associated with their profile.
Profiles may include information such as a name, biography, professional information, contact details, profile photograph, website, social media links, portfolio and projects.
Information that users choose to publish as part of their profile may be publicly accessible through the FUTURES website.
You are responsible for ensuring that the information you provide is accurate and that you have the right to provide and publish it.
You should not include personal information relating to another person unless you have a lawful basis and the necessary permission to do so.
5. Content uploaded to the platform
Where the platform allows users to upload or publish content, users may provide materials such as images, videos, PDF documents, texts, project information and external links.
You remain responsible for the content you upload or publish.
You must ensure that you have the necessary rights and permissions to make the content available through the FUTURES platform.
You must not upload or publish content that:
- infringes the intellectual property rights, privacy rights or other rights of another person;
- is unlawful, fraudulent or misleading;
- contains malicious software or material intended to interfere with the operation or security of the platform;
- is defamatory, abusive or otherwise unlawful; or
- violates applicable laws or regulations.
FUTURES does not routinely pre-approve or moderate content before it is published.
FUTURES may, however, remove or restrict access to content where it reasonably considers this necessary to comply with these Terms, applicable law, a legal request, or to protect the platform, its users or third parties.
6. Intellectual property
FUTURES and its licensors retain all rights in the FUTURES platform, including its design, structure, branding, logos, text, graphics and other materials created or provided by FUTURES, except where otherwise stated.
You may use the platform and its publicly available content for personal, professional, educational or other lawful purposes consistent with the purpose of the FUTURES platform.
You may not reproduce, distribute, modify, commercially exploit or otherwise use FUTURES content in a way that infringes FUTURES' rights or applicable law.
Content created by artists and other users
Users retain ownership of the intellectual property rights in the content they provide through the platform.
Where a separate agreement exists between FUTURES and a user concerning the use of their work or content, that agreement applies to the relevant rights and uses.
In particular, the use by FUTURES of works covered by a separate licensing agreement is governed by the terms of that agreement.
Nothing in these Terms transfers ownership of an artist's work or overrides a separate agreement between FUTURES and the artist.
7. Public profiles and contact information
The FUTURES platform is designed to make information about the FUTURES network, its participants and their work discoverable to the public.
Users understand that information included in a public profile may be viewed and accessed by visitors to the platform.
Where a user chooses to make an email address or other contact information publicly available through their profile, visitors may use that information to contact them directly.
FUTURES is not responsible for communications or interactions that take place directly between users and third parties as a result of information published on the platform.
Users should therefore only publish contact information that they are comfortable making publicly available.
8. Third-party content and services
The FUTURES platform may contain links to or content provided by third-party websites and services, including social media platforms, video hosting services and other external websites.
Third-party websites and services are governed by their own terms and privacy policies.
FUTURES does not control and is not responsible for the content, availability, security or privacy practices of third-party websites or services.
The inclusion of a link or embedded content does not necessarily constitute an endorsement by FUTURES.
9. Availability and changes to the platform
FUTURES aims to keep the platform available and functioning properly but does not guarantee that the website will always be available, uninterrupted or free from errors.
FUTURES may modify, update, suspend or discontinue parts of the platform from time to time.
This may include changes to features, profile functionality, programmes, content or other aspects of the platform.
Where reasonably possible, FUTURES will take appropriate steps to minimise disruption to users.
10. Profiles and participation in FUTURES
Participation in the FUTURES network or a FUTURES programme does not necessarily guarantee that a profile will remain active indefinitely.
Where a person's or organisation's participation in FUTURES comes to an end, FUTURES may retain the relevant profile as part of its historical and archival record of the network and its programmes.
Where applicable, the continued use of artistic works after the end of participation is governed by the relevant licensing agreement.
A user may contact FUTURES to request the removal or modification of information associated with their profile.
FUTURES will consider such requests in accordance with applicable agreements and data protection law.
11. Suspension and removal
FUTURES may suspend or restrict access to an account or remove content or a profile where this is reasonably necessary, including where:
- these Terms have been breached;
- information provided by a user is materially inaccurate or misleading;
- content infringes the rights of another person;
- the use of the platform is unlawful;
- necessary to comply with a legal obligation or request;
- necessary to protect the security or integrity of the platform; or
- a user's participation in a FUTURES programme or network relationship has ended.
Where appropriate and reasonably possible, FUTURES may contact the relevant user before taking such action.
Nothing in this section affects any rights or obligations arising under a separate agreement between FUTURES and a user.
12. Responsibility and liability
FUTURES makes reasonable efforts to provide accurate and up-to-date information on the platform. However, FUTURES does not guarantee that all information will always be complete, accurate or current.
FUTURES is not responsible for:
- content provided by users;
- the actions or omissions of users or third parties;
- interactions between users and third parties;
- the content or availability of external websites;
- temporary interruptions or technical failures beyond FUTURES' reasonable control; or
- loss or damage resulting from use of the platform to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
13. Changes to these Terms
FUTURES may update these Terms from time to time to reflect changes to the platform, its services, programmes or applicable legal requirements.
The updated version will be published on the website and will indicate the date on which it was last updated.
Your continued use of the platform after the updated Terms have been published constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
Where a change materially affects existing users, FUTURES will take reasonable steps to communicate the change where appropriate.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands, unless mandatory provisions of the law applicable to you provide otherwise.
Any dispute arising from or relating to these Terms will be submitted to the competent courts in the Netherlands, unless applicable law requires otherwise.
