This Privacy Policy explains how Stichting FUTURES processes personal data when you visit or use the FUTURES website and platform.
FUTURES is a European photography platform made up of member organisations across Europe and co-funded by the Creative Europe programme of the European Union.

This Privacy Policy applies to the FUTURES website and platform. It does not apply to third-party websites, platforms or services that may be accessible through links or other content available on the FUTURES website.

2. What personal data do we process?
The personal data processed by FUTURES depends on how you interact with the platform.

Browsing data
When you visit the FUTURES website, the systems used to operate the website may automatically process certain technical information, such as your IP address, browser and device information, the pages or resources requested, the date and time of the request, and information relating to the operation and security of the website. This information is primarily used to ensure that the website functions properly, maintain its security and understand how the website is used.

Information provided by users
When you contact FUTURES, create or manage a profile, participate in a FUTURES programme, subscribe to the newsletter or otherwise use features of the platform, we process the information you provide in connection with that activity. Depending on the context, this may include information such as your name, email address, date of birth, biography, location, professional information, profile photograph, website, social media or other online channels, portfolio and project information, and other information included in your profile or communications with FUTURES. Not all of these categories of information are necessarily collected from every user. The information processed depends on the profile, programme, service or functionality concerned.

Profile and portfolio information
Some FUTURES participants can create and manage public profiles on the platform. Information included in a public profile may be accessible to visitors to the FUTURES website. This may include professional information, biographies, photographs, portfolios, projects, websites, social media links and contact information provided by the user. Users are responsible for ensuring that the information they choose to publish through their profile is accurate and that they have the necessary rights and permissions to provide it.

Information received from other sources
In some circumstances, FUTURES may receive information about individuals from member organisations, cultural institutions or other organisations involved in FUTURES activities. For example, this may occur in connection with artist nominations, participation in FUTURES programmes or other activities within the FUTURES network. Where personal data is obtained from a source other than the individual concerned, FUTURES provides the information required by applicable data protection law.

3. Why do we process personal data?
FUTURES processes personal data for purposes including:

operating and maintaining the FUTURES website and platform;
creating, authenticating and managing user accounts;
creating and managing profiles;
making information about artists, cultural professionals, institutions and FUTURES participants available through the platform;
presenting artists and their work as part of FUTURES activities;
administering and supporting the Education Programme, Residency Programme and other FUTURES activities;
managing relationships with member organisations and participants in the FUTURES network;
responding to enquiries and requests sent to FUTURES;
enabling users to contact participants who have chosen to make contact information available through their profile;
sending the FUTURES newsletter where the user has subscribed to it;
understanding how the website is used and improving its content, functionality and performance;
maintaining the security and proper functioning of the website and platform;
complying with legal obligations; and
establishing, exercising or defending legal claims where necessary.

FUTURES will not use personal data for purposes that are incompatible with the purposes for which the data were collected without providing the information required by applicable law.

Depending on the specific processing activity, FUTURES relies on one or more of the following legal bases under Article 6 of the GDPR:

Where required, FUTURES processes personal data on the basis of your consent.

FUTURES may process personal data where this is necessary to comply with a legal obligation applicable to FUTURES.

Legitimate interests
FUTURES may process personal data where this is necessary for its legitimate interests, provided that those interests are not overridden by the interests or fundamental rights and freedoms of the individual concerned. These interests may include operating and securing the platform, maintaining its functionality, managing the FUTURES network and activities, preventing misuse, and establishing or defending legal claims. The specific legal basis depends on the processing activity concerned.

5. Is providing personal data mandatory?
Some personal data is necessary to use particular features or services of the FUTURES platform. For example, certain information may be required to create and manage an account, participate in a programme, respond to an enquiry or subscribe to the newsletter. Information that you choose to include in a public profile may be visible to other visitors to the platform.

6. Public profiles and contact information
An important function of the FUTURES platform is to make artists, professionals, institutions and their work discoverable to the public.
Where a user creates a public profile, information included in that profile may therefore be publicly accessible. Users may also choose to provide an email address or other contact details through their profile. Where a user chooses to make such information public, visitors may use it to contact them directly. FUTURES does not control communications that take place directly between users and third parties as a result of information made publicly available through the platform.

7. Who receives personal data?
Personal data may be accessed or processed by:

FUTURES staff and persons authorised to process personal data on behalf of FUTURES;
service providers supporting the operation, hosting, maintenance, development and security of the website and platform;
providers of specific services used by FUTURES, where necessary for the relevant service;
member organisations or other organisations involved in FUTURES activities, where this is necessary for the relevant activity or relationship; and
public authorities, courts or other competent bodies where disclosure is required by law or necessary for the establishment, exercise or defence of legal claims.

Where a service provider processes personal data on behalf of FUTURES, FUTURES takes appropriate steps to ensure that the processing is governed by the applicable data protection requirements.

8. International transfers
Some of the service providers used by FUTURES may process personal data outside the European Economic Area.
Where personal data is transferred to a country outside the EEA, FUTURES will ensure that the transfer is carried out in accordance with applicable data protection law, including, where relevant, on the basis of an adequacy decision, appropriate safeguards such as Standard Contractual Clauses, or another lawful transfer mechanism. The specific international transfers may depend on the services and technical configuration used by the FUTURES platform.

9. How long do we keep personal data?
FUTURES retains personal data only for as long as necessary for the purposes for which it was collected, unless a longer period is required or permitted by law.
Different categories of information may therefore be retained for different periods.
In particular:

Account information is retained for as long as the account remains active and for an appropriate period afterwards where necessary for legal, administrative or archival purposes.
Public profile information may remain available as part of the historical and archival record of FUTURES, including after a person's participation in FUTURES has ended, subject to applicable agreements and data protection law.
Portfolio and project information is retained in accordance with the relevant relationship or agreement with FUTURES. Where a separate licensing agreement applies, that agreement also governs the relevant use and retention of artistic works.
Contact requests are retained for as long as reasonably necessary to handle the request and any related follow-up.
Newsletter information is retained while you remain subscribed and for an appropriate period afterwards where necessary to record your subscription preferences or comply with legal obligations.
Technical and analytics data is retained in accordance with the applicable technical configuration and the periods described in the Cookie Policy.

Where appropriate, FUTURES may periodically review stored personal data and delete or anonymise information that is no longer necessary.

10. Cookies and analytics
FUTURES uses cookies and similar technologies on its website.
These may include strictly necessary technologies required for the operation and security of the website, as well as non-essential technologies used for analytics or third-party content. FUTURES currently uses Google Analytics for website analytics and YouTube for video content.

11. Newsletter
FUTURES operates a newsletter for people who wish to receive news, articles, interviews, events, Open Studios, educational opportunities and other updates relating to FUTURES. The newsletter is distributed using Mailchimp.

You can subscribe to the newsletter by providing the information requested through the newsletter sign-up form. You can unsubscribe at any time using the unsubscribe option included in the newsletter or by contacting FUTURES.

12. Automated decision-making and profiling
FUTURES does not make decisions concerning individuals based solely on automated processing that produce legal effects or similarly significant effects. FUTURES does not carry out profiling of users for such purposes.

13. Your rights
Under applicable data protection law, you may have the right to:

obtain confirmation as to whether FUTURES processes personal data about you and request access to that data;
request correction of inaccurate or incomplete personal data;
request deletion of your personal data, where the legal requirements for deletion are met;
request restriction of processing, where the applicable requirements are met;
object to certain processing of your personal data;
receive personal data in a structured, commonly used and machine-readable format and request its transmission to another controller, where the right to data portability applies;
withdraw consent at any time where processing is based on consent; and
lodge a complaint with a competent data protection supervisory authority.

These rights are subject to the conditions and limitations provided by applicable law.

14. How to exercise your rights

FUTURES will respond to requests without undue delay and, in principle, within one month of receiving the request. This period may be extended where permitted by applicable law, in which case you will be informed of the extension and the reasons for it.
FUTURES may need to verify your identity before responding to a request.

The exercise of your rights is generally free of charge. Where applicable law permits, FUTURES may charge a reasonable fee or refuse to act on a request that is manifestly unfounded or excessive.

15. Right to lodge a complaint
If you believe that FUTURES has processed your personal data unlawfully, you have the right to lodge a complaint with a competent data protection supervisory authority.

As FUTURES is established in the Netherlands, the competent supervisory authority is generally the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

This does not affect your right to contact another supervisory authority where permitted by applicable law.

16. Changes to this Privacy Policy
FUTURES may update this Privacy Policy from time to time to reflect changes in the FUTURES platform, the services we provide, the technologies we use or applicable legal requirements. The date at the top of this Privacy Policy indicates when it was last updated.
